Your privacy matters to us. This Privacy Policy explains how NexMotion Technologies ("we," "us," "our") collects, uses, processes, and protects your personal information in accordance with South Africa's Protection of Personal Information Act (POPIA) and other applicable data protection laws.

3. Categories of Personal Information We Collect

3.1 Account and Profile Information

  • What we collect: Full name, email address, phone number, company name, job title
  • How collected: Registration forms, account settings, profile updates
  • Legal basis: Contract performance, consent
  • Required/Optional: Name and email required; other information optional

3.2 Payment and Billing Information

  • What we collect: Billing address, payment history, transaction details
  • How collected: Payment forms processed by our secure payment provider, PayFast (Pty) Ltd
  • Legal basis: Contract performance
  • Required/Optional: Required for paid services

Note: We do not store credit card details. All payment information is securely processed by our certified payment providers.

3.3 Usage and Technical Information

  • What we collect: IP address, browser type, device information, operating system, login times, feature usage, session duration
  • How collected: Automatic collection through our platform and analytics tools
  • Legal basis: Legitimate interests, consent (for non-essential cookies)

4. How We Use Your Information

We use your personal information for the following purposes:

5. Data Sharing and Disclosure

We do not sell your personal information. We may share your information with:

Service Providers

Named third-party vendors who help us operate our platform, each contractually or procedurally obligated to protect your data: Google Firebase (account data storage and authentication), PayFast (Pty) Ltd (payment processing), and Google Analytics (website usage analytics, optional, see Cookies below). Where you use an AI-powered NexMotion product such as Pampiri, document content you submit is additionally processed by Together AI Inc. and Google Cloud Vision as described in that product's own Privacy Policy, only after you give a separate, itemised consent naming those processors.

When required by law, court order, or to protect our legal rights and safety.

Business Transfers

In connection with mergers, acquisitions, or sale of assets (with notice to you).

With Your Consent

When you explicitly authorize us to share specific information.

5.1 Cross-Border Transfer of Personal Information

Some of our service providers are located, or store data, outside South Africa, principally in the United States. In accordance with section 72 of POPIA, we only transfer personal information outside South Africa where at least one of the following applies:

  • Binding agreement (section 72(1)(b)): Google Firebase and Google Analytics are used under Google's standard data processing terms, which incorporate appropriate international transfer safeguards.
  • Your consent (section 72(1)(a)): Where an AI-powered product such as Pampiri sends your document content to Together AI Inc. (United States) for processing, this is done only after you give explicit, informed consent to that specific transfer through that product's dedicated AI-processing consent flow — not under a data processing agreement with Together AI, which does not currently exist. See Pampiri's Privacy Policy for the full detail of that transfer.

6. Your Rights Under POPIA

You have the following rights regarding your personal information:

Right of Access

Request confirmation of personal information processing and receive a copy of your data.

Response time: 30 days maximum

Right to Correction

Request correction of inaccurate or incomplete information. Update account details directly through your profile.

Immediate via profile settings

Right to Deletion

Request deletion of personal information when no longer necessary for the purposes collected.

Response time: 30 days maximum

Right to Object

Object to processing based on legitimate interests, opt-out of marketing communications.

Immediate for marketing

Right to Data Portability

Receive your personal information in a structured, machine-readable format.

Response time: 30 days maximum

Right to Withdraw Consent

Withdraw consent for any consent-based processing at any time.

How to Exercise Your Rights

Contact us at support@nexmotiontechnologies.co.za with your request. We will respond within 30 days and verify your identity before processing.

7. Data Security Measures

Technical Safeguards

  • Encryption: AES-256 encryption at rest, TLS 1.3 in transit
  • Access Controls: Multi-factor authentication, role-based permissions
  • Network Security: Firewalls, intrusion detection systems
  • Monitoring: 24/7 security monitoring and incident response

Organizational Measures

  • Regular security training for all employees
  • Background checks for personnel with data access
  • Confidentiality agreements and security policies
  • Regular security audits and assessments

Security Compromise Notification

If a security compromise occurs that has compromised or may reasonably be believed to have compromised your personal information, we will notify the Information Regulator and you, as the affected data subject, as soon as reasonably possible after discovery, in accordance with section 22 of POPIA. Our internal target is to notify the Information Regulator within 72 hours of becoming aware of a qualifying security compromise. Where the full facts are not yet known within that time, we will provide an initial notification and follow up with further detail as it becomes available. Our notification will describe, to the extent known: the nature of the compromise, the personal information reasonably believed to be affected, the measures we have taken or plan to take, and a recommendation of steps you can take to mitigate any adverse effects.

8. Data Retention

We retain your personal information for as long as necessary to:

  • Provide our services to you
  • Comply with legal obligations
  • Resolve disputes and enforce our agreements
